1. Scope and conclusion of the contract

These General Terms and Conditions apply to the agreed letting of the Seeblick, Säntisblick and Rosengarten holiday apartments and to agreed additional services at Haus Säntisblick, provided they have been validly incorporated into the respective contract. The landlords are Jutta and Reimund Menner, hereinafter referred to as “the landlord”.

A contract is concluded when the landlord accepts the guest’s booking. Bookings may be made, in particular, by email, telephone or in person. A non-binding enquiry alone does not constitute a contract.

Individual agreements take precedence over these Terms and Conditions. For bookings through external portals, the terms agreed for the specific booking on that portal also apply. Any different payment and cancellation terms of the portal booking take precedence over the corresponding provisions of these Terms and Conditions.

Anyone making a booking on behalf of other people must be authorised to do so. These Terms and Conditions do not establish additional personal liability for all fellow travellers. Statutory liability provisions remain unaffected.

2. Services and prices

The scope of services is determined by the agreed booking offer, the corresponding apartment description and the agreements made. The landlord provides the booked apartment for the agreed period.

The agreed nightly rates include utilities, bed linen, hand and bath towels, final cleaning and any VAT payable by law. Local tourist tax is charged separately in accordance with the applicable municipal regulations.

Additional services subject to a charge, in particular electric car charging, are agreed separately. The applicable price is communicated before the service is used.

3. Payment and security deposit

Payment is made in accordance with the written agreement in the booking contract. An advance payment is required. Haus Säntisblick determines the amount, which is approximately 30% of the total price. Haus Säntisblick sets the payment deadline. The specific advance payment and deadline are communicated to the guest before the contract is concluded and are contractually agreed.

The remaining balance must reach the Haus Säntisblick bank account no later than two weeks before arrival. Appropriate payment arrangements will be agreed for short-notice bookings.

A security deposit may be agreed. Its amount and due date are communicated before the contract is concluded. An agreed security deposit must be paid before the keys are handed over.

If the apartment is returned without any issues, the security deposit is refunded without interest. Where there are justified claims that still require examination, only a reasonable portion may be withheld temporarily. The landlord will settle the deposit promptly once the matter has been clarified.

If payments due are not made, the landlord may withdraw from or terminate the contract, subject to the statutory requirements, after a reasonable additional payment period has expired without payment. The guest’s statutory defences and rights of retention remain unaffected.

4. Arrival, departure and use

The holiday apartment is available from 15:30 on the agreed arrival date. On the departure date, it must be vacated and returned by 09:30 at the latest. Different times require agreement.

The apartment may only be occupied by the agreed number of people. Letting other people use it or subletting requires the landlord’s prior consent.

The guest must treat the apartment, its furnishings and the shared facilities with care and be considerate of other guests and neighbours. Damage and significant disturbances must be reported to the landlord without delay.

Smoking is not permitted in the holiday apartments. Pets are not allowed. Statutorily protected rights to bring an assistance dog remain unaffected. Cannabis consumption is not permitted in the apartments or anywhere on the property.

In the event of significant breaches of contract, termination is governed by the statutory requirements. Where required, a warning or an opportunity to remedy the breach must first be given. A breach does not automatically result in the loss of all the guest’s rights.

5. Cancellation and no-show

5.1 Direct bookings with Haus Säntisblick

For bookings made directly with Haus Säntisblick, the guest may cancel free of charge up to and including 60 calendar days before the agreed arrival date. The date the cancellation reaches the landlord is decisive.

For clear documentation, please cancel in text form, for example by email to ferien@familie-menner.de. The validity of an unambiguous cancellation notice does not depend on confirmation by the landlord.

If a booking is cancelled within the free cancellation period, payments already made for the cancelled stay will be refunded without delay.

For later cancellations or no-shows, 90% of the agreed accommodation price is charged for the nights not used. In the event of early departure, this applies to the remaining booked nights. This flat-rate charge allows for saved expenses of 10%.

Income from re-letting the apartment for the same period is credited in the guest’s favour. The landlord will endeavour to re-let the apartment. The same accommodation service will not be charged twice.

The guest is expressly permitted to demonstrate that no claim for payment or compensation exists, or that it is substantially lower than the flat-rate charge, in particular because greater expenses were saved.

Payments already made are credited against any remaining claim. Overpayments are refunded. Tourist tax is charged only to the extent actually payable under the applicable regulations. Separately charged additional services that were not provided are not included in the cancellation charge.

5.2 Bookings through external portals

For bookings made through external booking portals, the cancellation deadlines and charges agreed at the time of the respective booking apply. The free cancellation period of up to 60 days before arrival under section 5.1 does not automatically apply to portal bookings.

Please refer to your booking confirmation and the cancellation procedure specified there. Different individual agreements with the landlord remain unaffected.

5.3 Statutory rights and travel insurance

Statutory rights to withdraw from or terminate the contract or to reduce the price remain unaffected by the cancellation provisions above. This applies in particular if the landlord cannot provide the accommodation owed.

Taking out travel cancellation insurance and, where appropriate, travel curtailment insurance is recommended. Insurance cover is governed exclusively by the respective insurance contract.

6. Service problems and liability

Guests are asked to report defects or disturbances promptly so that the landlord can remedy them. The guest’s statutory rights remain unaffected.

If the accommodation cannot be provided as agreed, the rights and obligations of both parties are governed by the statutory provisions. A mere change of intention to let the property or a wish to use it personally does not give the landlord a general right to withdraw from the contract.

The landlord is liable in accordance with the statutory provisions for damage caused intentionally or through gross negligence, and for culpably caused injury to life, limb or health.

In the event of a slightly negligent breach of essential contractual obligations, the landlord is liable for foreseeable damage typical of the contract. Essential contractual obligations are those whose fulfilment makes proper performance of the contract possible and on whose observance the guest may regularly rely. Otherwise, liability for slight negligence is excluded.

The liability provisions above also apply to the conduct of legal representatives and persons used to perform contractual obligations. Mandatory statutory liability and guarantees given remain unaffected. These Terms and Conditions do not exclude any statutory liability for guests’ belongings brought onto the premises.

These liability provisions also apply to Wi-Fi, car and bicycle parking spaces, the wallbox and bicycle charging facilities. The guest is liable under the statutory provisions for damage for which they are responsible.

7. Guest Wi-Fi

Overnight guests are provided with free internet access through a password-protected FRITZ!Box guest network. Guests receive the Wi-Fi password from the landlord.

Access credentials must be protected from unauthorised disclosure. Sharing them with people who are not authorised guests requires the landlord’s consent. Permission to use the network ends with the stay.

Guests must not use the connection for unlawful activities. In particular, copyright infringement, distribution of unlawful content, attacks on other systems and sending malware or spam are prohibited.

Other users and network operation must not be adversely affected. In the event of specific security risks or significant misuse, the landlord may temporarily restrict or block access to the extent necessary and proportionate.

The speed actually available depends, among other things, on the internet connection, network load, location and device used. A specific speed is owed only if expressly agreed. Statutory rights in the event of service problems remain unaffected.

Guests are responsible for the security of their devices, keeping software up to date and backing up their own data. Support or repair of private devices is not included in the service. Section 6 applies to the landlord’s liability.

Use of the guest Wi-Fi does not constitute blanket consent to additional data storage or monitoring of internet use. Privacy information about any logging functions actually used will be provided separately.

8. Car and bicycle parking

One free car parking space is available for each holiday apartment. Any additional parking requirements must be agreed with the landlord before arrival. Vehicles may only be parked in the allocated spaces.

The parking spaces are unguarded. No special guarding or safekeeping service is agreed. Liability under section 6 remains unaffected.

In the parking and garage areas, open flames, smoking, storage of flammable substances, unnecessary engine idling, refuelling, vehicle repairs and washing are prohibited. Vehicles leaking operating fluids must not be parked there.

Bicycles, e-bikes and, where applicable, bicycle carriers must be stored in the allocated spaces in the garage. The garage door must be closed again after placing or removing them. Cars and bicycles should be locked and valuables should not be left behind.

9. Electric car charging

Use of the wallbox is subject to a charge and must be agreed with the landlord in advance. Intended use and the vehicle registration number must be communicated when booking. Use is limited to one vehicle per apartment.

The wallbox has a nominal charging capacity of up to 22 kW and a Type 2 connector. The actual charging rate depends, among other things, on the vehicle and technical operating conditions.

Charging takes place outside the garage using the cable provided. Adapters must not be used. After use, return the cable and connector to the holder provided. The landlord activates the charger and retains the key.

The price per kWh, including any applicable taxes, is communicated and agreed before charging starts. Charges are based on measured consumption, calculated from the difference between the meter readings before and after use. Statutory metering and billing requirements must be met. Charging costs must be paid in cash before departure.

Damaged vehicles, connectors or cables must not be connected or used. Faults must be reported promptly. In the event of specific safety risks or technical defects, use may be suspended until these have been remedied. The guest’s statutory rights remain unaffected.

Unless otherwise agreed, use ends at 08:00 on the departure date. Making the facility available to third parties is not permitted. Section 6 applies to damage.

10. Bicycle battery charging

Overnight guests may charge bicycle batteries free of charge at the designated places in the garage.

For fire safety reasons, bicycle batteries may only be charged there. Charging and storing bicycle batteries in the holiday apartments is not permitted.

Only undamaged batteries and suitable, undamaged chargers may be used in accordance with the manufacturer’s instructions. Abnormalities such as excessive heat, deformation or smoke must be reported immediately; use must stop immediately if there is a danger.

In the event of specific safety risks or technical defects, the landlord may temporarily suspend use. Unless otherwise agreed, use ends at 08:00 on the departure date. Use by other people requires the landlord’s consent. Section 6 applies to damage.

11. Final provisions

The statutory rules on jurisdiction apply. No exclusive place of jurisdiction is agreed for consumers.

German law applies. For consumers, mandatory protective provisions of the country of their habitual residence remain unaffected insofar as they are applicable by law.

Individual agreements take precedence. Changes should be recorded in text form for evidential purposes. The priority of valid individual oral agreements remains unaffected.

If individual provisions are invalid, the statutory provisions apply.
